If you feel that a family member of yours died because of negligence on the part of someone else, you can definitely file a wrongful death lawsuit. You will need to hire an attorney who specializes in wrongful death cases. Make sure it is someone who has won a few cases in this arena. You will need to have the medical records of your deceased family member available. The hospital will have all the records so your attorney might have to request that they be released.

 

How can you get the best results from a lawsuit? In the case of a death that results from negligent medical care, you need to sit down and write out everything that you can remember about your family member’s treatment from the very beginning of their hospital stay or the beginning of their medical treatment plan. Try to remember all the details about the specific incident that caused their death. In other words, if you remember talking to the doctor about allergies your relative had to specific medications, and that medicine was given, be sure to document telling him/her.

 

If you remember incidents in which you reminded the medical staff about certain conditions that your relative had and found out later that these were not recorded in their records, write it down. Be sure to spend the time going over everything you can remember, as this detailed information is what your wrongful death attorney will need when you go to trial.

 

What if you can't prove anything specific? You can still get a wrongful death claim.
