There is a general misconception about commercial trucking that the operators of these giant machines are unsafe and that the trucks are treacherous roadway companions. However, rules, laws, and regulations put in place by the government and the trucking industry make these vehicles among the quality controlled and the drivers some of the most restricted on the road. In fact, drivers of regular cars and trucks can be much more dangerous; there is a much higher percentage of passenger vehicles operated daily by exhausted, distracted, and even drunk drivers.

However, accidents involving large trucks do happen and they can be harmful or even fatal, which is why there is a law system in place to protect the victims and families of these accidents. If you are faced with such a situation, there are a few matters that you should be aware of that make large truck accident lawsuits slightly different than the ordinary auto accident case.

First, you will most likely not be faced with a single driver. Commercial trucking companies, manufacturers, and insurance agencies can all be found liable for the expenses incurred as a result of the accident. While this may mean a larger payout for the victim, it can also mean fighting against better equipped attorneys and defendants who are very familiar with this type of situation. This means that you would be wise to arm yourself with an experienced lawyer familiar with trucking laws and regulations and large truck accidents. This is because, although negligence is determined in much the same manner as in the typical auto accident, federal and state laws are in place which mandate certain protocols of the commercial trucking industry from how many hours are allowed to be driven per day to the way in which a trailer must be loaded. If these laws were not obeyed and your attorney can prove it, then your case is an immediate success.

Occasionally, the trucking company, insurance agency, or manufacturer will temporarily admit fault in the situation and offer a quick settlement without a lawsuit. Although it can make for a very fast resolution, consulting an attorney will protect you from lesser compensation than what is deserved. If the settlement is accepted, the situation is done; otherwise, the case will move forward. Just as is the case with most auto accident cases, most large truck lawsuits will settle out of court. Only a very tiny percentage of large truck accident cases end in trial where damages are assessed by a judge or jury; and the victim is awarded a lump sum to cover the costs of medical bills, lost wages, psychological detriment, or for other such considerations.
